MYNIC will be launching its Domain Name Dispute Resolution Service (MYDRP) on Thursday 17 April 2003 to resolve disputes between the registrant of a .my top-level domain and a third party concerning who has the right to the registration and/or use of the domain name.
This dispute resolution is governed by terms set out in MYNIC’s Domain Name Dispute Resolution Policy and any party wanting to participate in a domain name dispute resolution proceeding must comply with these terms. The MYDRP remedies are to transfer or delete the domain name registration.
Globally, disputes arising from alleged abusive registrations of generic top level domain names (gTLDs), such as .com and .net, are filed with and arbitrated by approved dispute-resolution service providers appointed by the Internet Corporation for Assigned Names and Numbers (ICANN). More information on this is available on ICANN’s website (www.icann.org).
Before participating in a proceeding governed by the MYDRP, parties are strongly encouraged to first explore the possibility of settling disputes through negotiations, mediation, conciliation or any other alternative dispute resolution process.
Complaints are to be filed with the Regional Centre for Arbitration Kuala Lumpur (www.rcakl.org.my). An independent Administrative Panel appointed by the Centre decides the proceedings. Parties have a choice of opting for a single or three-member Panel. The MYDRP documents were released for public comments in September 2002, and MYNIC would like to take this opportunity to thank all parties who submitted their comments on the same.
MYNIC’s Agreement for Registration of Domain Names was revised to cater for the MYDRP process and became applicable on 1st March 2003.
