Public Comments on MYNIC's Domain Name Dispute Resolution Policy (MYDRP)

Dear Valued Customers,

The Malaysian Network Information Centre (MYNIC) plans to introduce a Domain Name Dispute Resolution Service to resolve disputes between the registrant of a .my top-level domain and a third party over the registration or use of a domain name.

This .my dispute resolution is governed by terms set out in MYNIC’s Domain Name Dispute Resolution Policy (MYDRP).  Any party wanting to participate in a .my domain name dispute resolution proceeding must comply with these terms.

Globally, disputes arising from alleged abusive registrations of generic top level domain names (gTLDs), such as .com and .net, are filed with and arbitrated by approved dispute-resolution service providers appointed by the Internet Corporation for Assigned Names and Numbers (ICANN).  More information is available on ICANN’s website (Uniform Domain-Name Dispute-Resolution Policy (UDRP)).

Before participating in a proceeding governed by MYDRP, parties are strongly encouraged to first explore the possibility of settling disputes through negotiation, mediation, conciliation or any other alternative dispute resolution process.  The remedies offered as part of MYNIC’s Domain Name Dispute Resolution Service are to transfer, delete or modify the domain name registration.

Complaints are to be filed with the Regional Centre for Arbitration Kuala Lumpur. Proceedings are heard by an independent Administrative Panel appointed by the Centre.

Prior to the implementation of the MYDRP, members of the public are welcome to submit their comments on the four documents above to mydrpcomments@mynic.net.my. The comments would be most useful if they were substantiated with rationales, examples and alternative proposals.  Kindly also include full contact particulars such as full name, designation and organisation name (if relevant), postal address, e-mail address and contact numbers.
